Understanding the changing patent landscape in the EU and US

The current decade has brought and will bring substantial changes to patent law and practice in the key markets of the EU and US. In the EU, the biggest change to the patent system since 1978 is likely to come into effect at some point in 2017, with the introduction of the Unitary Patent and Unified Patent Court.  In the US, a series of Supreme Court decisions have significantly impacted the area of patentable subject matter and resulted in the introduction of revised guidelines from the USPTO.  Further cases may be in the pipeline for the US Supreme Court to consider.  This seminar will give an overview of these changes and discuss the implications for IP management.

Richard Willoughby, partner, D Young & Co LLP
 
Richard is a solicitor specialising in patent litigation with over 20 years’ experience. He has extensive knowledge of multi-jurisdictional patent litigation in Europe, the US and Asia. He has represented high profile clients in litigation before the UK Courts, and in connection with parallel cases in other jurisdictions in a wide range of technological fields including life sciences, chemicals and mechanical engineering. Richard has been actively involved in lobbying and consulting in relation to the unitary patent and Unified Patent Court project for a number of years, both in his capacity as the current Chair of the Laws Committee of the Licensing Executives Society (LES) (Britain & Ireland) and generally as an informal consultee to organisations such as the UKIPO.
 
Kirk Gallagher, partner, D Young & Co LLP
 
Kirk is a UK and European patent attorney.  He advises a range of clients including multinational companies, SMEs and academic institutions in patent matters in the field of organic chemistry and especially pharmaceuticals and nutrition. His practice encompasses drafting, filing and prosecution of patent applications with a particular emphasis on the preparation of infringement and validity opinions and EPO opposition/appeal proceedings.  In relation to several of these cases Kirk has also gained experience of co-ordinating strategy between EPO oppositions/appeal proceedings and corresponding litigation in other jurisdictions, across Europe and the US. Prior to joining D Young & Co, Kirk worked as an in-house patent attorney at GlaxoSmithKline. In 2006 Kirk was seconded to the New York law firm Kenyon & Kenyon.  He is also qualified to represent clients in the Higher Courts as a patent attorney litigator.

The seminar will last approximately one hour and there will be wine and networking at the end.
